Jury awards Nektar $90M in Rezpeg dispute with Eli Lilly
Jurors found Lilly breached the implied covenant of good faith in its agreement to develop the autoimmune drug, but rejected Nektar's claim that the company failed to use commercially reasonable efforts.
A San Francisco jury found that Eli Lilly & Company breached an implied covenant of good faith in its agreement with Nektar Therapeutics to develop an experimental autoimmune drug Rezpeg, awarding the plaintiff $90 million in damages, according to a U.S. Securities and Exchange Commission filing.
Nektar, represented by Quinn Emanuel Urquhart & Sullivan LLP, argued that Lilly gave up on the drug to avoid competing with Ebglyss, an eczema treatment it had acquired in its $1....
