Plaintiffs accusing Adobe of secretly tracking their activity across websites failed to show they had a reasonable expectation that their online data would remain private, a federal judge ruled Wednesday in dismissing the lawsuit with leave to amend.
U.S. District Judge Noël Wise found that simply alleging users did not consent to Adobe's tracking was insufficient, citing previous rulings holding that internet activity generally carries a diminished expectation of privacy.
