HPE-Juniper ruling raises questions about future of Tunney Act

A San Jose federal judge approved the HPE-Juniper antitrust settlement despite disclosure violations, prompting legal experts to question whether the Watergate-era Tunney Act can meaningfully police Justice Department deals with companies.

Legal experts said a federal judge's approval of the Justice Department's settlement of its antitrust challenge to Hewlett Packard Enterprise Co.'s acquisition of Juniper Networks Inc. raises questions about whether a Watergate-era law to provide transparency and court oversight is a dead letter.
