LA city, county want amended homelessness suit tossed
“Plaintiffs added a race-based equal protection claim, citing the higher rate at which African-Americans experience homelessness,” wrote J. Mira Hashmall, partner at Miller Barondess LLP, who represents the Los Angeles County in the matter. “Plaintiffs also added individual plaintiffs who identify as Black, but that does not cure the deficiencies in the equal protection claim. Membership in a protected class, alone, does not demonstrate a violation of equal protection.”
The city and county of Los Angeles moved for dismissal of a newly amended lawsuit filed by a coalition of property owners, business operators and skid row residents over homelessnesss. Both municipalities argued the plaintiffs have yet to cite any harm that could be traced back to government defendants.
