Berkeley sex assault policies may encourage misconduct, judge says
“The plaintiffs have plausibly alleged that the university maintained a de facto policy of deliberate indifference toward sexual misconduct that created a heightened risk of harassment that was obvious,” wrote U.S. District Judge William H. Orrick of San Francisco in a ruling Thursday.
A federal judge refused to dismiss Thursday a lawsuit by three women claiming UC Berkeley upheld policies on campus sexual violence proceedings that encouraged incidents of misconduct.
