Affirming its own precedent, the U.S. Supreme Court ruled Monday states are protected by sovereign immunity when sued for copyright infringement.
The high court ruled Congress was barred from using its authority over copyrights to deprive states of sovereign immunity. The law, the Copyright Remedy Clarification Act of 1990, known as the CRCA, was intended to abrogate state sovereign immunity.
