Big tech presses Supreme Court on patent review rules

Tesla and Intel have joined Google in asking the U.S. Supreme Court to review Patent and Trademark Office policies that now routinely block inter partes review of older patents and those tied to pending litigation, though experts say the statute's broad grant of discretion to the director may make the challenge an uphill fight.

More companies, including Tesla Inc. and Intel Corp., are challenging U.S. Patent and Trademark Office policies that have blocked inter partes review not only if patents are more than six years old but also if patent infringement litigation is pending.
