Attorney sanctioned $5,000 over frivolous writ petition

California appellate court fined attorney Byron Husted $5,000 after finding he failed to disclose that a trial conflict cited in his writ petition had already been resolved.

A state appellate court sanctioned attorney Byron K. Husted $5,000 for filing a frivolous writ petition over a trial conflict that no longer existed.

In an unpublished Aug. 12 opinion, the 4th District Court of Appeal, Division Three found Husted, of PHG Law Group, breached his duty of candor by saying a San Diego trial conflicted with his client's June 29 trial date without disclosing that the trial had been continued to October.
