Court allows class action testing utility billing under debt collection laws

A Los Angeles judge denied Minol Inc.'s demurrer in a proposed statewide class action alleging the utility billing company unlawfully operated as an unlicensed debt collector. The ruling allows the case to move into discovery and could test whether third-party utility billing companies are subject to California's Rosenthal Fair Debt Collection Practices Act.

A Los Angeles County Superior Court judge on Wednesday overruled a demurrer in its entirety in a proposed statewide class action that seeks to test whether a third-party utility billing company can be held liable under California's Rosenthal Fair Debt Collection Practices Act and the state's debt collection licensing laws.
