Judge rejects sanctions bid in CIPA suit, faults plaintiffs' counsel
A federal magistrate judge denied a motion to sanction Rack Room Shoes and its attorneys in a privacy lawsuit, criticizing plaintiffs' counsel for filing the motion without first resolving a discovery dispute through discussions with opposing counsel.
U.S. Magistrate Judge Sallie Kim criticized the plaintiffs' attorneys in a privacy lawsuit against Rack Room Shoes for asking her to sanction the defense's Manatt, Phelps & Phillips LLP, lawyers instead of trying to resolve their issues outside of court.
"They could've explained to you what happened," Kim said. "And you wouldn't be here."
