Judge bars Zync from pursuing ITC trade secrets complaint against BMW

Senior U.S. District Judge Charles R. Breyer ruled that a forum-selection clause requiring litigation in Munich governs the parties' claims. 

Vehicle entertainment system startup Zync Inc. from participating in a federal investigation stemming from a trade secret theft complaint it brought against BWM due to a forum selection clause in its contract with the German carmaker, Senior U.S. District Judge Charles R. Breyer ruled Monday.

Breyer granted BMW -- Finnegan, Henderson, Farabow, Garrett & Dunner LLP -- a preliminary injunction, finding the forum selection clause required Zync to bring the action in Munich, home ...
