Reluctant defendant must sit for deposition in $77M coverage fight

A man at the center of a San Jose crash must testify or face sanctions as an insurer disputes coverage for a multimillion-dollar judgment.

The man at the center of a San Jose car crash that led to a $77 million personal injury judgment has escaped civil contempt and sanctions despite telling attorneys he would "never sit for a deposition," in a federal case over an insurance company's refusal to pay the award.

After a hearing Wednesday, U.S. Magistrate Judge Nathanael Cousins ordered James Brown to sit for a two-hour deposition by April 30, warning that failure to comply will result in a $5,000 sanction...
