Federal judge strikes convenience stores' antitrust action against PepsiCo

A federal judge in Los Angeles dismissed a putative class action accusing PepsiCo and Frito-Lay of unlawfully favoring large grocery chains over small convenience stores, ruling that the plaintiffs' Robinson-Patman Act claims lack a workable class framework but granting leave to amend.

A federal judge in Los Angeles has struck a putative class action by convenience stores that had accused PepsiCo Inc. and its Frito-Lay subsidiary of unlawfully favoring large grocery stores by overcharging small retailers for potato chips.

The ruling by U.S. District Judge Monica Ramirez Almadani knocked out the plaintiffs' antitrust complaint under the Robinson-Patman Act at the pleading stage.
