Bid to disqualify The Gap's lead trial lawyer fails weeks before trial claiming $378M

A San Francisco judge refused to disqualify Gap's trial counsel in a contract dispute, finding the reseller's motion likely tactical and allowing the case to proceed to trial.

A San Francisco Superior Court judge has rejected an attempt to disqualify The Gap Inc.'s lead trial lawyer in a $378 million contract and fraud dispute against a former reseller, suggesting it was an attempt to delay the trial set for next month.

In a ruling Thursday, Judge Christine Van Aken denied SVES GO LLC's motion to remove Michael A. Geibelson of Robins Kaplan LLP from representing Gap at trial, as well as a related request to depose him as a fact witness.
