Chiquita Canyon landfill seeks to slash noxious air liability claims

Chiquita Canyon Landfill's defense moves to dismiss liability claims in a toxic emissions lawsuit, arguing plaintiffs' amended pleadings overstep, as the case nears discovery after two years.

Counsel defending Chiquita Canyon Landfill in a mass tort litigation over toxic chemical emissions argued the case needs to be significantly reduced because of amended pleadings that have turned the case into an improper liability dispute.

The case involves a slew of Southern California resident-plaintiffs who claimed the 639-acre Santa Clarita Valley landfill has been releasing mismanaged gases into the air that made them sick.
