Practitioners are concerned the “Non-Exam Pathway” to Bar admission is not appropriate for California
The "non-exam pathway" appears unlikely to ensure substantive knowledge of the law, legal writing, or analytical skills under an objective and uniform standard, and instead would allow licensure based on a varying and subjective standard that can be easily manipulated.
In 2021, the California Supreme Court formed a Blue Ribbon Commission on the Future of the Bar Exam (BRC). The BRC is charged with "developing recommendations concerning whether and what changes to make to the California Bar Exam, and whether to adopt alternative or additional testing or tools to ensure minimum competence to practice law." The California Supreme Court and State Bar appointed 19 members to the BRC, five of whom are law school faculty.
