Santa Clara County sheriff points to ambiguity in the law as her defense

Allen J. Ruby of Los Gatos asserted in his March 1 memorandum of points and authorities that the statute in question and the legal standard to be imposed are woefully vague in the grand jury’s corruption allegations against Santa Clara County Sheriff Laurie Smith.

The defense for Santa Clara County Sheriff Laurie Smith against allegations of corruption in issuing concealed carry gun permits is being built on ambiguities in the Penal Code and Government Code, according to a memorandum filed by her attorney.

Allen J. Ruby of Los Gatos asserted in his March 1 memorandum of points and authorities that the statute in question and the legal standard to be imposed are woefully vague.
