LA judge agrees with jury, man can’t sue brother after statute expires

Los Angeles Superior Court Judge Mark V. Mooney upheld a defense verdict that barred plaintiff Shailesh Jogani from suing his brother Haresh Jogani for $250 million in a real estate business due to statute of limitations. Mooney also said Shailesh’s equitable estoppel claim was damaged by doctrine of unclean hands, as Shailesh admitted to having perjured himself and to have entered into a conspiracy to deprive his older brother Shashikant Jogani profits from the brothers’ real estate business.

A Los Angeles judge refused to overturn a jury's verdict that a man could not sue his brother over a soured real estate partnership because the statute of limitations had lapsed.

In doing so, Superior Court Judge Mark V. Mooney found that plaintiff Shailesh Jogani's own admissions of fraud and perjury barred him from seeking equitable relief.
