Appellate panel split on constitutionality of pre-2019 felony murder

An appellate panel split on whether or not the state’s former law regarding second degree felony murder was unconstitutionally vague, though there seemed to be a general consensus the Legislature was right to amend it.

An appellate panel split on whether or not the state's former law regarding second degree felony murder was unconstitutionally vague, though there seemed to be a general consensus the Legislature was right to amend it.

The 4th District Court of Appeal decision, published Monday, upheld the sentence for a man serving 19 years to life for a second degree felony conviction, saying the panel was bound by the case before them.
