Contract doctors not liable as custodians or caretakers, jury finds

Attorneys with Lewis Brisbois Bisgaard & Smith LLP secured a unanimous verdict in favor of defendants Vohra Wound Physicians of California, PC, in a multimillion dollar neglect and physical abuse case in Sacramento County Superior Court involving an 88-year-old woman who sustained leg complications which resulted in a below-the-knee amputation. The woman sued for elder abuse/neglect and sought an excess of $2.6M in medical expenses.

A unanimous Sacramento County jury found in favor of physicians accused of neglect in an elder abuse case, a result defense counsel said offers significant clarification on who is deemed a patient's caretaker or custodian in cases where contractors are involved.
