9th Circuit sits en banc to mull EPA pesticide challenge

The 9th U.S. Circuit Court of Appeals sitting en banc Tuesday appeared concerned that the U.S. Environmental Protection Agency is intentionally refusing to respond to objections levied against the agency’s decision not to ban a widely-sued insecticide and struggled to get a clear answer from a government attorney as to when a response would come.
