Protections against construction defect claims revived

On Aug. 26, the 5th District Court of Appeal published an opinion holding that the
Right to Repair Act, commonly known in the homebuilding industry as SB 800, applies
to all claims by homeowners alleging construction defects, whether expressly alleged
under the act, or alleged as common law claims such as negligence or breach of warranty.
