Federal judge rules bank's mortgage underwriters cannot get overtime pay

An Eastern District judge said the underwriters exercise too much independent discretion and therefore are exempt from overtime pay under the Federal Labor Standards Act.

Tossing aside a framework often used to determine who is exempt from overtime, a federal
judge on Wednesday ruled a bank's mortgage underwriters exercise too much independent
discretion to get time-and-a-half pay after working more than 40 hours in a week.
